Welcome to Wichita Hypnotherapy LLC (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our psychotherapy services, website, and any communication between us, including phone, email, and text message interactions. By accessing or using our services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you should not use our services.

1. Services Provided

We offer psychotherapy services, including in-person and virtual therapy sessions, assessments, and consultations. Our services are provided by licensed mental health professionals and are designed to support your mental health and well-being.

 

2. Eligibility

​

You must be at least 18 years of age to use our services without parental consent. If you are under 18, parental consent is required for any services provided.

 

3. Client Responsibilities

  • You agree to provide accurate, current, and complete information when using our services.

  • You acknowledge that therapy is a collaborative process and agree to participate actively.

  • You are responsible for ensuring a suitable and private environment when engaging in virtual therapy sessions.

  • You must inform us of any medical, psychiatric, or emergency situations that could affect the therapy process.

 

4. Appointments and Cancellations

  • Appointment Scheduling: Appointments are scheduled based on availability. We will make reasonable efforts to accommodate your preferred times.

  • Cancellations: If you need to cancel an appointment, you must provide at least 2 hour before appointment.
    Notice. Failure to cancel within this time may result in a cancellation fee. 

 

5. Payments and Billing

  • Fees: Our fees are communicated to you at the time of scheduling. Payment for services is due at the time of your appointment unless other arrangements have been made.

  • Methods of Payment: We accept various forms of payment, including credit cards, debit cards, and electronic payment systems.

  • Late Payments: Unpaid balances may be subject to late fees. We reserve the right to suspend services for clients with overdue accounts.

 

6. HIPAA Compliance and Confidentiality

We are committed to protecting your privacy and ensuring compliance with HIPAA regulations. All communications and records are treated as confidential. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your personal data.

 

7. Emergency Situations

Our services are not suitable for emergency situations. If you are in crisis or require immediate assistance, please contact your local emergency services, go to the nearest emergency room, or call the National Suicide Prevention Lifeline at 1-800-273-TALK (8255), or text the Crisis Text Line by texting 741741 24/7 for support. 

 

8. Limitation of Liability

  • No Guarantee of Results: While our goal is to support your mental health and well-being, we make no guarantees regarding the outcome or effectiveness of the services provided. Therapy is a complex process, and results may vary from person to person.

  • Disclaimer of Warranties: We provide our services "as is" without any warranties, express or implied. We do not warrant that our services will meet your specific needs or expectations.

  • Limitation on Damages: To the fullest extent permitted by law, Wichita Hypnotherapy LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to emotional distress, lost profits, or business interruptions.

 

9. Indemnification

You agree to indemnify, defend, and hold harmless Wichita Hypnotherapy LLC, its officers, directors, employees, affiliates, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including attorney fees) arising from:

  • Your breach of these Terms

  • Your violation of any law or the rights of a third party

  • Your use of our services in a manner not expressly authorized by these Terms

  • Any claims of negligence or malpractice arising from your interactions with us

 

10. Intellectual Property

All content provided through our services, including text, graphics, logos, and other material, is the property of Wichita Hypnotherapy LLC and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works based on our content without our express written consent.

 

11. Termination of Services

We reserve the right to terminate or suspend your access to our services at any time, without notice, for any reason, including a violation of these Terms. Upon termination, you must cease using our services immediately, and any outstanding payments remain due.

 

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Kansas and the United States. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Sedgwich County, Kansas.

 

13. Dispute Resolution

Any disputes related to these Terms or our services will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. By using our services, you agree to waive your right to bring claims in court or participate in class-action lawsuits.

 

14. Force Majeure

We are not liable for any delays or failures to provide services due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, wars, terrorism, or pandemics.
